Privacy policy
Last updated: October 2026
Who we are
Fair Payments Pty Ltd ("FairPayments") helps Australian businesses apply for card payment services with payment providers, including Nuvei, Clover and Tyro. We are not a bank or a payment provider ourselves. This policy explains how we handle personal information in line with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).
What we collect
When you use our website, call us or apply through us, we may collect:
- your name, date of birth, residential address, mobile number and email address;
- business details, such as the ABN, legal and trading names, business address and phone, industry, card turnover, number of terminals and website;
- identity documents, including your driver's licence number and photos of the front and back of your licence that you upload;
- bank details for settlement (bank name, account name, BSB and account number) and a bank statement that you upload;
- any questions you send us, call-back requests, and notes from our calls with you;
- basic website data, such as how you reached our site (for example a referral or campaign link) and technical information your browser sends.
We use Google Analytics to see how many people visit our pages and how they move around the site; it does not record what you type into our forms.
We collect this information directly from you. If you don't provide it, we may not be able to prepare or submit an application for you.
Why we collect it and how we use it
- to prepare and submit a merchant application to the payment provider you choose (such as Nuvei, Clover or Tyro);
- to help the provider verify your identity and business and meet its own legal obligations, including anti-money laundering and counter-terrorism financing checks;
- to make sure settlement funds are paid into the right bank account;
- to contact you about your application, answer questions and provide ongoing support;
- to keep records and meet our own legal obligations.
We don't sell your personal information. If we send you marketing, you can opt out at any time.
Who we share it with
We may disclose your personal information to:
- the payment provider you ask us to apply to, such as Nuvei, Clover or Tyro, and their related entities, so they can assess and set up your merchant facility. The provider's own privacy policy applies once it receives your information;
- service providers that help us run our business, such as our customer relationship management (CRM) system, email, phone and hosting providers;
- anyone else you authorise, or where the law requires or allows it.
Some of these service providers or payment providers may store or access information outside Australia. Where that happens, we take reasonable steps to make sure your information is handled consistently with the APPs.
How we store and protect it
Application details and the documents you upload (licence photos and bank statements) are sent over an encrypted connection and stored in our CRM, Zoho CRM, which is provided by Zoho Corporation. Access is limited to FairPayments staff who need it to handle your application. Unfinished application details may also be kept in your own browser until you finish or clear the form.
We take reasonable steps to protect personal information from misuse, interference, loss and unauthorised access, modification or disclosure. When we no longer need information for any purpose permitted by law, we take reasonable steps to destroy or de-identify it.
Access and correction
You can ask for access to the personal information we hold about you, or ask us to correct it if it's inaccurate, out of date or incomplete. Contact us using the details below. We'll respond within a reasonable time, usually 30 days. If we refuse a request, we'll tell you why and how to complain.
Complaints
If you have a concern about how we handle your personal information, please contact us first so we can try to resolve it. If you're not satisfied with our response, you can contact the Office of the Australian Information Commissioner (OAIC) at oaic.gov.au or 1300 363 992.
